Ben & Jerry’s sues its parent company over the sale of its Israeli business

Ben & Jerry’s is suing its parent organization after the sale of its Israel enterprise to a community licensee, correctly circumventing the ice cream maker’s boycott of the place.

On June 28, the mother or father organization, Unilever, bought the Israel organization of Ben & Jerry’s to operator American Excellent Items for an undisclosed sum to “guarantee the ice cream stays readily available to all customers.”

Ben & Jerry’s has sought to conclude profits of its goods in the occupied West Lender and the annexed east Jerusalem, which the Palestinians assert as the money of a long run unbiased state that includes the West Bank and the Gaza Strip — also captured by Israel in 1967.

NBC Information first reported the firm’s withdrawal from Israeli settlements previous summer.

The most recent fit, filed Tuesday in New York Metropolis, claims the sale was not authorized by Ben & Jerry’s impartial board of directors. In accordance to the filing, the corporation is seeking “to protect the model and social integrity Ben & Jerry’s has invested a long time making.”

CNBC noted Tuesday that a judge had previously denied the ice product maker’s application for a momentary restraining purchase but however ordered Unilever to demonstrate cause by July 14 for why a preliminary injunction from the sale need to not be issued.

In a statement, Unilever said that “the deal has previously closed” and that it would not comment on pending litigation. A Ben & Jerry’s representative did not respond to a ask for for remark.

Past week, Ben & Jerry’s tweeted about its opposition to the sale. It explained it would no longer revenue from Ben & Jerry’s in Israel.

“We keep on to feel it is inconsistent with Ben & Jerry’s values for our ice cream to be bought in the Occupied Palestinian Territory,” it explained.

Israeli Overseas Minister Yair Lapid explained in a statement the Israeli authorities issued just after last week’s sale announcement: “The antisemites will not defeat us.

“Even when it comes to ice cream. We will fight efforts to delegitimize Israel and the boycott movement in all its forms, regardless of whether it be economic, cultural, or philosophical.”

The Palestinian-led Boycott, Divestment and Sanctions movement, or BDS, modeled on the boycott marketing campaign versus apartheid South Africa, aims to convey economic strain to bear on Israel around its military services profession of lands the Palestinians want for a upcoming point out.

Avi Zinger, the proprietor and CEO of American Excellent Merchandise, explained in a assertion that the sale by Unilever “ensures the sale of Ben and Jerry’s ice product created in Israel” all through the state, “including Judea and Samaria” — the names some in Israel use to refer to the West Financial institution.
